Authority of the Attorney General to Make Successive Designations of Interim United States Marshals

Under 28 U S.C. § 562, the Attorney General may make two or more successive designations of a person to serve as interim United States marshal in a judicial district where the marshal's office is vacant. After the expiration of an initial designation of a United States marshal under 28 U.S.C. § 562, the Attorney General may authorize a person to act as marshal under 28 U.S.C. §§ 509, 510. The OLC does not provide release dates for its opinions, so the release date listed is the date on which the opinion was authored.
